Charles County Circuit Court Judge Robert C. Nalley has received a citation for deflating the tire of a car parked illegally near the courthouse, La Plata police announced Friday afternoon.
The traffic citation for tampering with a motor vehicle, a misdemeanor that carries a maximum penalty of two months in prison, a $500 fine or both, was issued after a Montgomery County prosecutor reviewed the police investigation into the Aug. 10 tire deflation, according to La Plata Police Department Chief Cassin B. Gittings.
Nalley has acknowledged he flattened the tire of a car that he said kept parking in a restricted space next to the courthouse. He resigned last week from his position as chief administrative judge and was replaced by Judge Amy J. Bragunier. Nalley is still serving as an associate judge in Charles County Circuit Court.
Gittings said his department worked with Montgomery County Deputy State's Attorney John Maloney in the decision to issue Nalley the citation.
"Because Judge Nalley is a sitting judge this office regularly appears in front of, I thought it appropriate to ask for a prosecutor outside this circuit, and Montgomery County Deputy State's Attorney John Maloney indicated the Montgomery County State's Attorney's Office would handle the case," said Charles County State's Attorney Leonard C. Collins Jr.
Maloney and Nalley didn't return calls seeking comment.
