A Calvert County teenager was expected to return to juvenile court today, Wednesday, for further proceedings on an assault charge after a judge released him last week from pretrial custody at a state facility.
The 15-year-old Chesapeake Beach resident was detained in late August after his arrest by authorities alleging he stabbed a Baltimore County man in the chest with a knife at a camping site at Potomac Speedway in Budds Creek. The boy's lawyer said at an initial court proceeding that there were self-defense issues in the case.
A St. Mary's prosecutor said last week in court that she and the boy's lawyer agreed that a psychological examination has determined that the teenager is not a danger to the community, and that he could be placed on electronic monitoring at his parents' home. A juvenile services agent said the boy had attained the "highest level" of privileges while being held at the Cheltenham Youth Facility.
"We believe he was in the wrong place at the wrong time," the boy's father said in court of the incident leading to his son's arrest. "We've never had a problem with him. We want him to go home very bad. It's been devastating to the family."
Judge Michael J. Stamm ordered that the teenager be released from Cheltenham and that he remain at home, except for going to school and meeting with his attorney.
The man injured in the Aug. 21 incident, 21-year-old Adam Edward Layman of White Hall, has been charged with second-degree assault through another Calvert County teenager's charging application alleging Layman threatened and punched him that night at the speedway. A summons was issued for Layman on the misdemeanor charge, and a lawyer has filed court papers to represent him in the matter.
